Kenneth Clair’s case is presently back in court pending decisions involving the DA's handling and testing of evidence without the presence of Clair’s defense attorney. There are motions at the State and Federal level that have to be filed and heard to expedite this case. This process can take from months to years to resolve. Meanwhile Clair will be in custody waiting to have these issues heard and resolved.
The only way that this CASE can be resolved sooner, would be if the DA’s office would have the male DNA run that they got from the victim through the FBI Database. However the DA’s office does not want to know who really killed Linda Rodgers.
The DA’s office does not want to admit they made a serious mistake when they convicted Mr. Clair. The DA’s office does not feel that they have any kind of obligation to exonerate someone that they may have falsely imprisoned in the past, even with the present DNA evidence results that were not available then.
So at this point the DA’s office feels that it is more prudent to uphold a conviction that never had any physical evidence in the past and reject the DNA evidence recently discovered.
The DA’s office is spending thousands of Orange County Tax Payer Dollars to block any further attempts to have this evidence tested by the defense and to prolonging this case. The DA’s office is also secretly testing other evidence on this case frivolously attempting to tie Clair into other unsolved crimes- exhausting the samples that could be used later by the defense to exonerate Clair. The DA’s office is not sharing these results with the defense because each of these test reveal other results that do not match Clair.
It is far cheaper for the DA’s office to just run this unidentified DNA through the FBI base and find the real killer, but they are spending thousands of dollars not to do it.
The DA’s office run this type of DNA information regularly if they are trying to convict someone, but they feel that they have some type of “Entitlement” not to run DNA when it may rectify a mistake that they could have made.
